The prosecution may also rely on facts it believes make the alleged conduct more serious, such as a defendant’s criminal history, the use of a deadly weapon, the circumstances surrounding the offense, or the defendant’s alleged role in the conduct. A defense attorney’s job is not simply to accept the State’s characterization of those facts. The defense can challenge disputed allegations, provide important context, and present evidence that gives the court, prosecutor, or jury a more complete picture of both the case and the person accused.
